SAN FRANCISCO (Reuters) - A U.S. appeals court ruled on Friday that Google's Motorola Mobility unit cannot enforce a patent injunction that it obtained against Microsoft Corp in Germany.
The injunction would bar Microsoft from "offering, marketing, using or importing or possessing" in Germany some products including the Xbox 360 and certain Windows software.
The ruling against the German injunction came from the 9th U.S. Circuit Court of Appeals in San Francisco.
Representatives for both companies could not immediately be reached for comment.
The current Xbox 360 is the market-leading console in the United States. Microsoft is expected to unveil its next generation Xbox video game console in 2013.
Microsoft has said that Motorola's patents are standard, essential parts of its software and that Motorola is asking far too much in royalties for their use.
Microsoft sued Motorola in the United States in 2010, and Motorola then filed a lawsuit in Germany. In April, a federal judge in Seattle granted Microsoft's request for a temporary restraining order against Motorola in Germany.
In its ruling on Friday, a three-judge 9th Circuit unanimously upheld the lower court order. Since Microsoft had already brought a lawsuit against Motorola for breach of contract in the United States, U.S. courts have the power to put the German injunction on hold, the 9th Circuit said.
"At bottom, this case is a private dispute under Washington state contract law between two U.S. corporations," the court ruled.
European regulators are investigating claims that Motorola over-charged Microsoft and Apple Inc for use of its patents in their products and thereby breached antitrust rules.

New Delhi: A Group of Ministers (GoM) formed to examine certain provisions of the controversial Land Acquisition Bill met here today but no decisions were taken in the meeting.
?We will decide next time. This week, I am going to Vietnam and I will be back on October 4. After that, we will meet. Three members gave their views. No decision happened today,? Agriculture Minister and GoM Chairman Sharad Pawar told reporters after the meeting.
The government had constituted a 14-member GoM headed by Pawar last week after some ministers had voiced reservations against certain provisions of the Bill.
Rechristened as ?The Right to Fair Compensation, Resettlement, Rehabilitation and Transparency in Land Acquisition? Bill, it has been hanging fire since long even though the National Advisory Council headed by Sonia Gandhi has been pushing for the law and has framed its broad contours.
The Land Acquisition, Rehabilitation and Resettlement Bill, 2011 was introduced in Parliament in September last year and was referred to a Parliamentary Standing Committee which submitted its recommendations in May.
Meanwhile Urban Development Minister Kamal Nath told reporters that he suggested roping in gram panchayats to ensure fair price of agriculture land and the process of awarding compensation should be hastened.
?My concern is about the fair market value (of land). The fair market value is defined as the circle rate or the rate at which the (land) transfer is made. It is well known that the circle rate does not reflect the market price. The transactive price does not reflect the market price,? he said.
He claimed there is a difference in the price of land with high agriculture yield and it should be valued differently.
?I have suggested that gram panchayat must decide the price of land. There must be another stream of valuation to decide the piece of land. The land which has higher agri yield is different from the land which has no agri yield. It is a question of what is the agricultural yield of the land,? Nath said.
He suggested that the Bill should also include the issue of compensation paid to farmers.
?I want the process to be fast so that farmers get their compensation. One of the major concerns is that huge tracts of land have been acquired and notices have been issued but the compensation has not been paid. This must come within the ambit of the bill,? the Minister said.
Ministers who opposed certain provisions in the bill including Commerce Minister Anand Sharma, Urban Development Minister Kamal Nath and Highways Minister C P Joshi, sources said.

BRISTOL, Conn. (AP) ? Phoenix Mercury president Amber Cox is an avid user of social media.
She had just witnessed one of the greatest moments in team history when Phoenix won the WNBA draft lottery Wednesday night, earning the No. 1 pick and the chance to select Baylor's Brittney Griner.
Cox wanted to share the news with fans and coach Corey Gaines, who was in the television studio waiting for the draft order to be unveiled. Instead, she had to wait two hours until the results were broadcast on TV for the first time in league history. Cox and the other team executives who participated in the lottery were sequestered in a room, unable to access their phones or computers.
"It was tough, but it was fun to watch his reaction too, on TV," Cox said. "Corey's usually a cool customer and doesn't show any emotion, but he had a hard time holding that one in."
Cox was cool herself when the winning combination ? 4, 5, 6, 14 ? was drawn. There was no loud cheer or fist pump; she just sat there quietly taking in the moment.
The Mercury (7-27) had the second-worst record in the league this season and were assigned 276 of the 1,000 possible lottery combinations. Fortunately for Cox and the Mercury, one of those combos came up first.
"We're really excited. It means a lot to our fans, it means a lot to our organization," Cox said. "We're just really excited and kind of speechless at the moment. We came into the draft lottery today, Corey and I, with no expectations and, again, like he said, we knew that anyone we would be able to add to the pieces we already have would be good.
"This is obviously icing on the cake."
Chicago will pick second and Tulsa third. Washington, which had the worst record in the league, will pick fourth. The Mystics (5-29) had a 44-percent chance to win the top pick. Only four times in the 11 previous lotteries has the team with the worst record secured the top pick, and that hasn't happened since 2009.
Mystics chief operating officer Greg Bibb had a homemade pouch with him in the lottery room. It didn't help.
Neither Gaines nor Cox would commit to selecting Griner after the lottery results were announced.
"Griner has a unique skill set," Cox said. "We'll look at the class and it's our job over the next few months to figure out what's the best fit for us."
Griner, though, is a once-in-a-lifetime talent. The 6-foot-8 Baylor star is an unbelievable shot blocker and also can play above the rim. She helped guide Baylor to a national championship last year and the first 40-0 season in college basketball history. The reigning Associated Press player of the year will try to lead the Lady Bears to a second straight championship when the season starts next month.
"We like to fast break and you need to rebound and play defense to get out and run," said Gaines, smiling. "Obviously she can block shots and rebound the ball well."
Griner headlines a talented class. Delaware's Elena Delle Donne led the nation in scoring last season and is a versatile 6-foot-5 guard who can score from almost anywhere on the court. Notre Dame's Skylar Diggins has guided the Irish to the past two national championship games and is one of the most followed female athletes on Twitter.
"They all are very different players and can do different things for us," Cox said.
Phoenix was plagued by injuries most of the season. Star Diana Taurasi played in only eight games and Penny Taylor missed the entire year while recovering from an ACL injury. Candice Dupree also missed 21 games because of a knee injury.
"This was a difficult season with all the injuries we had," Gaines said. "The players this year tried so hard and now the texts are coming in from them. They are ready to come back and excited."
The Mercury have had the first pick in the draft two other times, including 2004 when they drafted Taurasi.
This was the first time that the lottery was shown on television. In the past, the lottery had been held later in the calendar year behind closed doors at a league meeting.
"This worked out great," WNBA President Laurel Richie said. "It creates a buzz and gets people talking now for the next few months until the draft in April."

ScienceDaily (Sep. 26, 2012) ? About 100 years ago, marine biologists hauled the first vampire squid up from the depths of the sea. Since that time, perhaps a dozen scientific papers have been published on this mysterious animal, but no one has been able to figure out exactly what it eats. A new paper by MBARI Postdoctoral Fellow Henk-Jan Hoving and Senior Scientist Bruce Robison shows for the first time that, unlike its relatives the octopuses and squids, which eat live prey, the vampire squid uses two thread-like filaments to capture bits of organic debris that sink down from the ocean surface into the deep sea.
It's easy to imagine the vampire squid as a nightmarish predator. It lurks in the eternal midnight of the deep sea, has a dark red body, huge blue eyes, and a cloak-like web that stretches between its eight arms. When threatened, it turns inside out, exposing rows of wicked-looking "cirri." Even its scientific name, Vampyroteuthis infernalis, means "vampire squid from hell."
In reality, the vampire squid is a soft-bodied, passive creature, about the size, shape, and color of a football. A "living fossil," it inhabits the deep waters of all the world's ocean basins at depths where there is almost no oxygen, but also relatively few predators.
A few previous researchers have caught vampire squids in nets, hauled them up to the surface, and tried to figure out what they ate by examining the contents of their stomachs. The results were generally inconclusive. The stomachs typically contained bits and pieces of tiny, shrimp-like animals, microscopic algae, and lots of slimy goo.
In a recent article in the Proceedings of the Royal Society B: Biological Sciences, Hoving and Robison show that vampire squids eat mostly "marine snow" -- a mixture of dead bodies, poop, and snot. The dead bodies are the remains of microscopic algae and animals that live in the waters farther up in the ocean, but sink down into the depths after they die. The poop consists of fecal pellets from small, shrimp-like animals such as copepods or krill. The snot is mostly debris from gelatinous animals called larvaceans, which filter and consume marine snow using mucus nets.
In addition to looking at the stomach-contents of vampire squids from museum collections, the researchers used MBARI's remotely operated vehicles (ROVs) to collect live vampire squids and study their feeding habits in the laboratory. They also examined high-definition videos of vampire squids taken by MBARI's ROVs. Finally, they examined vampire squid arms and feeding filaments under optical and scanning electron microscopes.
One key to Hoving and Robison's discovery was that they used MBARI's ROVs to collect living vampire squids, and were able to keep them alive in the laboratory for months at a time. Hoving soon found that if he placed bits and pieces of microscopic animals into a tank with a vampire squid, the food particles would stick to one of the string-like filaments that the animal sometimes extends outward from its body. The vampire squid would then draw the filament through its arms, removing the particles from the filament and enveloping them in mucus. Finally, the squid would transfer the glob of mucus and particles to its mouth and consume it.
Using MBARI's video annotation and reference system (VARS), Hoving also identified every MBARI ROV dive over the last 25 years during which researchers had seen a vampire squid. He then pored over 170 of these video clips (over 23 hours of footage) to look for additional clues as to what and how the animals ate.
The videos showed that vampire squids often drift motionless in the water, extending one of their thin filaments -- up to eight times as long as the animal's body -- like a fishing line. In many cases, Hoving saw bits of marine snow sticking to the filament. He also saw vampire squids slowly pulling in their filaments and scraping off the accumulated marine snow using their arms. Other vampire squids had globs of marine snow and mucus dangling from their mouths.
Under the microscope, the researchers observed that the vampire squid's suckers were covered with cells that produce mucus, which the animal apparently uses to collect and glue together individual particles of marine snow. Their filaments are covered with tiny hairs and a dense net of sensory nerves, which makes them extremely sensitive to touch.
When looking at vampire squids' stomach contents, the researchers did not see bones or pieces of individual animals that would indicate the vampire squids had captured live prey. Instead, they saw mostly amorphous bits of broken-up organic debris. The only prey they saw that might have been eaten alive were the remains of tiny crustaceans that sometimes "hitchhike" on sinking mucus nets or clumps of the marine snow.
After considering all the evidence, Hoving and Robison conclude that, "the vampire squid's filament is likely a multifunctional organ that is deployed to detect and capture detrital matter but at the same time may detect the presence of predators and perhaps small living prey."
The organic detritus that forms the bulk of the vampire squid's diet would not seem to be particularly nutritious. However vampire squids complement their frugal diet with an extremely energy-efficient lifestyle and unique adaptations. Their bodies are neutrally buoyant, so they don't have to expend energy to stay at a particular depth. Even better, they don't have to swim to find food, but simply extend their filaments to collect food that drifts past them.
Finally, vampire squids don't have to expend much energy avoiding predators, because they live at depths where there is so little oxygen that few other animals can survive. Conveniently, these deep, low-oxygen zones are often found where there is an abundance of life near the sea surface, which in turn creates lots of marine snow for vampire squids to eat. Hoving explains, "Because of its unique adaptations, the vampire squid is able to permanently and successfully inhabit the center of the oxygen minimum zone, an otherwise hostile environment where the vampire squid's predators are few, and its food is abundant."
Even though Hoving and Robison's research shows that the vampire squid is a "detritivore" rather than an active predator, its sinister appearance and stealthy habits will no doubt continue to fascinate both researchers and the general public.
