Apple, Foxconn, Criticized in Report, Promise ... - Business Ethics

The Fair Labor Association reported the results of ?the equivalent of a full-body scan? of working conditions at three Chinese factories operated by Apple Inc.?s major supplier Foxconn, and said both companies have pledged to bring their practices up to compliance with Fair Labor code standards.

Apple Factory The FLA said its nearly month-long investigation ?revealed serious and pressing noncompliances with FLA?s Workplace Code of Conduct, as well as Chinese labor law.? The findings called for a detailed set of remedial measures to protect employee health and safety, reduce worker hours to legal limits while protecting worker pay, and establish ?genuine avenues? for workers to provide input on company decisions.

Apple joined the FLA earlier this year following intense public attention over allegations of widespread problems at Foxconn, China?s largest private employer.

The FLA said both Apple and Foxconn ?have agreed to ongoing assessments by FLA in order to ensure that labor practices meet FLA standards and remain in compliance for the long term.?

The FLA monitors factories in the supply chains of affiliated companies to assess compliance with FLA standards and requirements; most of its more than 30 participating companies are clothing and footwear makers.? (At the time Apple joined the FLA, there was considerable?comment that the FLA inspections weren?t as rigorous as critics might like.)

Compensation Not Meeting "Basic Needs"

In its report, released March 29,?the FLA said its staff had put in 3,000 hours investigating three Foxconn factories and surveying more than 35,000 workers.

The probe found that within the last 12 months, all three factories exceeded the FLA standard of 60 hour work weeks (including overtime) and the Chinese legal limits of 40 hours a week and a maximum of 36 hours maximum overtime per month.

According to FLA?s worker survey, 64 percent of employees said that "compensation does not meet their basic needs."? FLA said it will conduct a cost of living study in Shenzhen and Chengdu to assist Foxconn in determining whether worker salaries meet FLA requirements for basic needs, as well as discretionary income.

"The assessment found that unscheduled overtime was only paid in 30-minute increments," FLA reported.? "This means, for example, that 29 minutes of overtime work results in no pay and 58 minutes results in only one unit of overtime pay."

FLA said it had also observed serious issues in areas such as health and safety, worker integration and communication, treatment of interns, and enrollment in China?s social security system.

The FLA report said Foxconn had agreed to revised its compensation packages to make up for the lost overtime, and would hire thousands of additional workers.

Broad Implications

The agreement likely will ripple through the Chinese electronics assembly sector, Reuters reported.

"Apple and Foxconn are obviously the two biggest players in this sector and since they're teaming up to drive this change, I really do think they set the bar for the rest of the sector," FLA President Auret van Heerden told Reuters in an interview. The Apple-Foxconn agreement may also raise costs for other manufacturers who contract with the Taiwanese company, including Dell Inc, Hewlett-Packard, Amazon.com Inc, Motorola Mobility Holdings, Nokia Oyj and Sony Corp.

Apple has confronted pressure on labor issues for a number of years, including from socially responsible investment firms.? Adam Kanzer, Managing Director and General Counsel of Domini Investments, said: "I think this is a very good day for the FLA, and for Apple as well. Together, they have demonstrated the power of transparency. The problems at Foxconn that were uncovered by the FLA are endemic in factories around the world -- this is not solely an Apple problem, but Apple is the only company in its industry that has committed to this level of transparency."

"It is too early to tell whether conditions will actually change at Foxconn, but I believe this public investigation has moved the needle," Mr. Kanzer added. "The FLA audit appears to have been rigorous and credible, and I expect to see more companies following Apple's lead. Millions of workers stand to benefit."

Some critics were skeptical about the promised improvements for workers.? ""In theory it's an improvement, but it actually has to happen. Without an effective oversight mechanism there is no accountability," said Justin Feldman, health and safety advocate for Public Citizen, an advocacy group.? Mr. Feldman added, ""We just can't trust the FLA. The FLA has a history of close alignment with corporations. Its board has had corporate representatives on it in the past."

Meg Roggensack, a senior advisor on business and human rights for Human Rights First, said, "The key to the report's success...will be implementation of this agreement. Talk is cheap. The steps needed to protect workers in Apple's supply chain may not be."

Reuters said the agreement could result in higher prices for consumers, though the impact will be limited because labor costs are only a small fraction of the total cost for most high-tech devices.

Ironically, one of the catalysts for the Apple/Foxconn inspections was a widely broadcast radio episode on This American Life repeating ?the assertions of monologist Mike Daisey that his research had turned up examples of worker exploitation at Foxconn.? This American Life later discovered that parts of his material couldn?t be confirmed, and broadcast a lengthy apology.

And Mr. Daisey subsequently has apologized as well, declaring on his blog: ?In my drive to tell this story and have it be heard, I lost my grounding. Things came out of my mouth that just weren?t true, and over time, I couldn?t even hear the difference myself.?

Syria accepts peace plan but clashes continue

QAA, Lebanon (AP) ? Syria accepted a cease-fire drawn up by U.N. envoy Kofi Annan on Tuesday, but the diplomatic breakthrough was swiftly overshadowed by intense clashes between government soldiers and rebels that sent bullets flying into Lebanon.

Opposition members accuse President Bashar Assad of agreeing to the plan to stall for time as his troops make a renewed push to kill off bastions of dissent. And the conflict just keeps getting deadlier: The U.N. said the death toll has grown to more than 9,000, a sobering assessment of a devastating year-old crackdown on the uprising that shows no sign of ending.

Annan's announcement that Syria had accepted his peace plan was met with deep skepticism.

"We are not sure if it's political maneuvering or a sincere act," said Louay Safi, a member of the opposition Syrian National Council. "We have no trust in the current regime. ... We have to see that they have stopped killing civilians."

Annan's plan calls for an immediate, two-hour halt in fighting every day to allow humanitarian access and medical evacuations. The plan also outlines a complete cease-fire, but that will take more time because Syria must first move troops and equipment out of cities and towns, government forces and the divided opposition must stop fighting, and a U.N.-supervised monitoring mission must be established.

U.S. Secretary of State Hillary Rodham Clinton said Assad must now act.

"Given Assad's history of overpromising and under-delivering, that commitment must now be matched by immediate action," Clinton told reporters in Washington. "We will judge Assad's sincerity and seriousness by what he does, not by what he says. If he is ready to bring this dark chapter in Syria's history to a close, he could prove it by immediately ordering regime forces to stop firing and begin withdrawing from populated areas."

British Foreign Secretary William Hague said Assad's decision was only a first step.

"We will continue to judge the Syrian regime by its practical actions, not by its often empty words," he said.

Annan, who is an envoy for the U.N. and the Arab League, has traveled to Russia and China to shore up support for his peace plan. Russia and China have twice shielded Assad from U.N. sanctions over his crackdown, saying the statements were unbalanced and blamed only the government. Syria is Moscow's last remaining ally in the Middle East and is a major customer for Russia's arms industry, but the Kremlin has recently shown impatience with Assad.

In Beijing on Tuesday, Annan said China has offered its "full support" for his mission.

In contrast, Iranian President Mahmoud Ahmadinejad offered Assad unequivocal support.

"I'm very happy that Syrian authorities are managing the situation with confidence," the official Iranian news agency quoted Ahmadinejad as saying. He echoed Assad's charge that rebels are acting out a Western conspiracy. "Americans want to dominate Syria, Lebanon, Iran and all other countries through the false slogan of defending the freedom of the (Syrian) people, and we must be alert toward their conspiracy," he said. Iran is one of Syria's last true allies.

Despite the high-level diplomacy, the situation on the ground remained as bloody as ever.

There were conflicting reports about whether Syrian troops physically crossed the border into Lebanon during heavy fighting near a rural area around the Lebanese village of Qaa.

Two Lebanese security officials told The Associated Press that only bullets whizzed across the frontier.

"There is no Syrian military presence on the Lebanese side of the border," a military official said, echoing an official denial on the state-run National News Agency, which also said there was no incursion.

But two witnesses in Qaa said they saw dozens of troops enter Lebanon, apparently chasing Syrian rebels. One witness said the Syrian troops burned several homes. Another man showed an AP reporter several high-caliber bullets that he said struck his home.

The witnesses asked not to be identified because of the sensitivity of the matter. An AP reporter at the scene could not verify that any houses were burned, however, as Lebanese soldiers had cordoned off the area. The border in the area is poorly demarcated, and residents cross into each country easily and frequently.

Crackles of gunfire from Syria were clearly heard, even hours after the firefights.

Any movement into Lebanese territory would escalate a conflict that already is spiraling toward civil war. There are concerns the violence could cause a broader conflagration by sucking in neighboring countries.

The Syrian uprising began in March 2011 with mostly peaceful protests as part of the Arab Spring. It turned increasingly militarized after the government unleashed tanks, snipers and troops with machine guns to break up protests ? a development that many opposition members say forced them to take up arms. The government denies there is a popular uprising, saying the revolt is being driven by armed groups and others it calls terrorists.

On Tuesday, Assad visited the third-largest city of Homs and its battered neighborhood of Baba Amr, a former opposition stronghold that has become a symbol of the uprising, in what appeared to be a show of his control over even the most rebellious areas.

A monthlong siege by the government to drive rebel fighters out of Baba Amr killed hundreds of people ? many of them civilians. Assad's forces overran the rebel-held district on March 1.

In video shown Syrian state TV, Assad appeared relaxed in a blue shirt and sports coat as he pledged that Baba Amr would return "better than it was before." He was greeted by residents who shouted, "We are with you until death!"

He met with soldiers and other supporters, shaking hands and embracing women who reached out to him.

The violent conflict has posed a serious challenge to Assad, but neither side has shown any sign of giving in. Assad still has a significant amount of support, particularly from religious minorities and others who feel they could be vulnerable if members of Syria's Sunni majority ? which makes up the backbone of the opposition ? take over the country.

Assad and his supporters have played on those fears, suggesting his ouster would spread chaos around the Middle East and leave the country in the hands of extremists.

The opposition, meanwhile, is riven by differences and failed to present a united front against Assad, adding to the chaos.

Opposition leaders met in Istanbul on Tuesday to try to resolve their differences and reassure international backers who are frustrated by the lack of cohesion.

A conference is scheduled for Sunday in Istanbul at which Turkey, the United States and their European and Arab partners will discuss ways to further isolate and pressure Assad, as well as measures to support the Syrian opposition. Some reports indicate that the debate among dozens of countries will include whether the opposition Syrian National Council and affiliated groups should be declared as the sole, legitimate representative of the Syrian people.

On Monday, a Turkish official indicated that a surge of Syrian refugees might compel Turkey, preferably with international backing, to establish a buffer zone on Syrian soil to guarantee the security of its own southern border as well as the welfare of civilians fleeing violence. Turkish officials have long been hesitant to create such a zone.

Establishing a buffer zone on the grounds of Turkish national security would sidestep the gridlock in the U.N. Security Council. But the move would likely lack international consensus, raise questions about Syria's territorial integrity and highlight a year of failed diplomacy.

Weight-Loss Surgeries May Beat Standard ... - Health News

MONDAY, March 26 (HealthDay News) ? A new international analysis comparing weight-loss procedures to standard diabetes treatments contends that surgery is more effective at helping people combat type 2 diabetes.

The finding stems from two years of tracking 60 severely obese patients with type 2 diabetes who were between the ages of 30 and 60. One-third of the patients were treated with diabetes drugs and diet/lifestyle modifications, while the rest underwent one of two surgical procedures: either Roux-en-Y gastric bypass or biliopancreatic diversion surgery.

The end result: all of the surgical patients were ultimately able to stop taking their diabetes medications, while the vast majority entered into full disease remission; neither outcome occurred in the traditional treatment group.

?We have known for many years that bariatric surgery, and specifically certain types of operations like gastric bypass, are very effective in terms of helping to control diabetes,? noted study senior author Dr. Francesco Rubino, chief of gastrointestinal metabolic surgery and director of the Metabolic and Diabetes Surgery Center at New York-Presbyterian/Weill Cornell in New York City.

?But what this new study shows is that even when you compare surgery against standard treatment, surgery performs far better in terms of the improvement that you can get in terms of diabetes,? he continued. ?Surgery dramatically reduces blood sugar levels, and very often surgical patients can stop taking the medications used for diabetes.?

Rubino and his colleagues from Rome?s Catholic University report their findings in the March 26 online edition of the New England Journal of Medicine, to coincide with a planned presentation on the findings at the American College of Cardiology annual meeting in Chicago. Cleveland Clinic researchers report similar findings in the same journal and plan to present the results at the same cardiology meeting.

In their study, the Cleveland Clinic doctors followed 150 patients with type 2 diabetes for a year, and found those who had undergone one of two types of weight-loss surgeries were much more likely than those on traditional therapies to get their blood sugar levels lowered to an optimal point and reduce their use of diabetes medications.

The Italian study authors pointed out that standard medicinal therapies, while effective, can pose their own set of problems. For one, insulin therapy can cause patients to gain weight, which itself can have a negative impact on diabetes.

To explore the comparative benefit of surgical options, the team focused on 60 diabetic patients who had a body mass index (BMI) of 35 or more (BMI is a measurement that takes into account height and weight, and over 30 is considered obese); all had a minimal five-year history of struggling with diabetes.

Undergoing treatment in Rome, the patients were randomly divided into three groups. The first was treated with conventional insulin therapy and a range of other hypoglycemic drugs, alongside what was described as ?rigorous? dietary and exercise counseling. The second and third group had one of the two types of bariatric surgery, and were placed on a daily regimen of vitamin and mineral supplementation.

The research team found that all of the surgical patients were able to stop taking all diabetes medications within just 15 days.

What?s more, at the two-year mark, three-quarters of those who underwent Roux-en-Y gastric bypass surgery had entered diabetes remission, meaning that for a minimum of one year they had a fasting glucose level under 100 milligrams/deciliter and a hemoglobin A1c count of less than 6.5 percent.

The same was true among 95 percent of the biliopancreatic surgery group. By contrast, none of the patients in the standard treatment group had entered remission.

The team observed that BMI levels, diabetes history, postsurgical weight loss, age and gender did not appear to play a role in the likelihood that patients would enter into diabetes remission.

?Two years is a relatively short outcome,? acknowledged Rubino. ?And this was a small study. But the effect of surgery was almost immediate among the surgical patients. And I think it?s clear that while patients getting medicinal therapy did improve somewhat, the chance for patients to achieve robust improvement in diabetes is much greater for those who have surgery than those who are treated with standard medications.?

Dr. Loren Wissner Greene, an endocrinologist at NYU Langone Medical Center in New York City, expressed little surprise at the findings.

?That?s been widely reported,? she noted. ?Of course, how one fares does depend on the individual. One can eat around any procedure, meaning that if a patient drinks high-caloric liquids following surgery, and manages not to lose weight, that can affect the result,? Greene explained.

?At the same time, there is very good evidence for diabetic remission after surgery, particularly for diverting procedures, where there could be a beneficial impact on gut hormones like leptin and ghrelin,? Greene added.

?There are some risks, however,? she cautioned. ?And people who have bad presurgical problems ? those with high blood pressure or obesity-related sleep apnea ? might be limited in terms of the type of obesity surgery they can get. But for those who can do it, it may really be the better way to go. And in the end, though surgery is extremely expensive, it might even be cheaper than having to take expensive diabetic medications for years to come.?

Court signals it will decide constitutionality of health care mandate

Updated at 3:10 pm ET:? After the first day of oral arguments in challenges?to the landmark 2010 health care law, it seems clear that Supreme Court will not let a procedural tax?issue stand in the way of deciding the constitutionality of the law.

?If there were any members of the court who were looking for an off ramp ? who did not want to decide this case now during an election year, this would have been the way to go,? said NBC's Pete Williams after hearing the first day's arguments. But ?none of them seem to want to take that,? he said.

At issue Monday was a law called the Anti-Injunction Act. Does that law require that those who challenge the penalty for failing to buy insurance actually pay the penalty first? That won?t occur until 2015, after the insurance purchase requirement takes effect.

The question hinged on the justices accepting the contention that the penalty is effectively a tax.

After hearing Monday?s argument, Williams reported that ?there didn?t seem to be a single member of the Supreme Court that bought that argument.?

?I don?t believe there?s a single justice on the court who believes that it?s a tax. End of that question. So we?re obviously going to go on to the main event which is the individual mandate which will be argued tomorrow,? Williams said.

Monday?s argument was the prelude for the main event: Tuesday?s two hours of argument over whether Congress has the power to require that almost every American purchase health insurance.

Solicitor General Donald Verrilli told the justices, "This case presents issues of great moment, and the Anti-Injunction Act does not bar the Court's consideration of those issues."

One justice, Samuel Alito, focused on the apparent inconsistency in the government's argument that the penalty?is not a tax, under the terms of the Anti-Injunction Act -- and yet the government also will claim in Tuesday's oral argument that when Congress created the individual mandate and?the penalty for failing to buy insurance,?it was acting under its constitutional power to tax.

Verrilli said, "Congress has authority under the taxing power to enact a measure not labeled as a tax ... ."

In a question to?Verrilli, Alito said, "Today you are arguing that the penalty is not a tax. Tomorrow you are going to be back and you will be arguing that the penalty is a tax. Has the Court ever held that something that is a tax for purposes of the taxing power under the Constitution is not a tax under the Anti-Injunction Act?"

Verrilli replied,?"No, Justice Alito, but the Court has held...?that something can be a constitutional exercise of the taxing power whether or not it is called a tax."

He said, "the nature of the inquiry that we will conduct tomorrow is different from the nature of the inquiry that we will conduct today. Tomorrow the question is whether Congress has the authority under the taxing power to enact it" and the?precise words used in the law don't have a crucial?effect on that question.

At least two justices, Stephen Breyer and Ruth Bader Ginsburg, seemed to accept the government's contention that the penalty was not a tax, with Ginsburg saying "this is not a revenue-raising measure, because, if it's successful, they won't -- nobody will pay the penalty and there will be no revenue to raise"

Since the plaintiffs challenging the ACA had not made the Anti-Injunction Act argument, the justices appointed lawyer Robert Long to argue for the position that no one can file suit against the ACA?s individual insurance mandate until after the penalty on those who fail to buy insurance has been assessed.

As soon as President Barack Obama signed the ACA into law, several states and private organization filed suits to overturn it, arguing that the Constitution gave Congress no power to force people to buy insurance.

Long pointed out in his brief that the text of the ACA says the penalty imposed on people who don?t purchase health insurance shall be ?assessed and collected in the same manner as taxes??-- so it is effectively a tax.

Long also said if Congress had wanted to create an exception to the Anti-Injunction Act in this case it would have done so when it passed the ACA in 2010.

He argued that for the Supreme Court to decide now on the constitutionality of the ACA ?would be contrary to the policy that courts avoid deciding constitutional issues unless it is necessary to so do.?

nd it would premature, he said, for the court to act since it?s possible that Congress ?could amend or repeal the Affordable Care Act at some point before penalties are assessed and collected, beginning in 2015. An amendment (to the law) could avoid the need for this Court to decide the constitutional issue presented in this case.?

But despite those arguments there?s tremendous pressure on the high court to resolve the uncertainty over the health care overhaul now?-- since many of the provisions of the law are interrelated and the court itself has created the expectation that it will finally settle the constitutional issue.

Arguing the case on Monday for 90 minutes were Long, Verrilli, and former Assistant Attorney General Gregory Katsas, now in private practice, representing the state of Florida and other states and the National Federation of Independent Business.

Facebook asks judge to toss out Ceglia suit

Facebook urged a federal judge on Monday to throw out a lawsuit by a New York wood pellet salesman who said he deserves half of founder Mark Zuckerberg's stake in the social media company, calling the case a "fraud."

Paul Ceglia, who has lived in Wellsville, N.Y., sued Zuckerberg and Facebook - now one of the world's most valuable companies - in 2010 in a dispute over a 2003 contract.

Facebook has repeatedly said Ceglia was a fraud and that a "Work for Hire Document" was a forgery and emails he purportedly exchanged with Zuckerberg were made up. Last year, the presiding judge in U.S. District Court in Buffalo, N.Y., gave Facebook more time to gather evidence.

"The evidence is in. And it is devastating for Ceglia and his cohorts," Facebook's lawyers wrote in a motion to dismiss filed on Monday.

"Ceglia and his co-conspirators have compounded their wrongdoing by destroying and tampering with evidence, obstructing discovery, and defying court orders."

They said they had found emails, dating back to Zuckerberg's days at Harvard University, to prove Ceglia's fraud.

They asked the judge to halt Ceglia's lawsuit, which they said was filed "in hopes of extorting a settlement through their fraudulent scheme."

A lawyer for Ceglia could not immediately be reached to comment.

Ceglia said he hired Zuckerberg when he was a Harvard University freshman for multiple projects, one of which eventually became Facebook.

Founded by Zuckerberg in a Harvard dorm room and now based in Menlo Park, California, Facebook is the world's No. 1 online social network with more than 845 million users.

In February, Facebook filed with securities regulators to raise $5 billion in an initial public offering. Zuckerberg controls 28.4 percent of Facebook's Class B shares, a filing shows.

Facebook may be worth $93.6 billion, according to SharesPost Inc, which tracks valuations of private companies.

The case is Ceglia v. Zuckerberg et al, U.S. District Court, Western District of New York, No. 10-00569.

The patent states that the benefit of a glass-enclosed gadget is that it will be radio transparent, making it ?a suitable material for an enclosure of an electronic device capable of wireless communications.?

Besides the aesthetically pleasing appearance, the device could be hermetically sealed and thus waterproof, the article says.

Although most glass materials included in smartphones are strong enough to withstand a few blows, one made entirely out of glass might be easier to damage if dropped. Another concern is that sensors within the phone could have problems functioning in a transparent enclosure, but Mashable said Apple?s application suggests certain parts of the case could be made opaque to avoid this problem.

Another rumor circulating about the new iPhone says it will have a 4.6-inch screen, nearly as big the Samsung Galaxy Nexus.
